Because the ARIAS•U.S. Code of Conduct (the “Code”) sets forth considerations and behavioral standards only for arbitrators, the questions in this course will address only the conduct of arbitrators. Nevertheless, it is expected that the parties and their counsel will conform their own behavior to the Canons and will avoid placing arbitrators in a position where they are unable to sit or are otherwise at risk of contravening the Canons. Some of the behavior and actions of the non-arbitrator participants in the fact patterns used for this Ethics Exam may fail to meet this standard, and you should not assume that such behavior and actions are sanctioned or approved by ARIAS•U.S.
It is also the case that this exam has as its primary objective to educate by applying certain hypotheticals that are designed to implicate sections of the Code, as noted. Neither the hypotheticals nor the responses are intended to be used for any other purpose, as even minor changes to hypotheticals can lead to changes in results and/or distinct sections of the Code being implicated. The hypotheticals used in this exam are fictional and not intended to reflect actual disputes.
